五、竞价主要条款

FOR:

- LOADING: 1SA ,SANGKULIRANG , EAST KALIMANTAN, INDONESIA

- DISCHARGING: 1SB DATANG NANJING POWER PLANT OR OTHER PORT,CHINA

- LAYCAN: 22TH MAR—26TH MAR, 2023(LT TO APPLY)

- LOADING RATE: 8,000 MTS PWWD OF 24 CONSECUTIVE HRS, SHINC,MAJOR HOLIDAY EXCLUD;

- DISCHCARGING RATE:12,000 MTS PWWD OF 24 CONSECUTIVE HRS,SHINC;

- - NOR:

AT L/P:

A valid Notice of Readiness (NOR) can be tendered within agreed laycan in writing (e-mail) after the Vessel has arrived at the Loading anchorage, declared the Vessel is in all respects ready to load, unless the vessel is failed to pass the Customs & free pratique prior to or on arrival at the mooring/berth. The NOR to be tendered ATDN SSHINC, Indonesian Major Indonesian Holidays excluded; if used, actual time used to count. If the loading berth/anchorage is occupied on vessel’s arrival, NOR can be tendered whether in berth or not from the usual waiting area. if after berthing the vessel is found not to be free pratique ,laytime shall be deemed not to have commenced until when the vessel has granted free pratique and obtained necessary customs clearance.

In any event, time lost for completion of Pratique after arriving at the Load Port shall not be counted as Laytime.

Laytime(L/P)

Laytime shall commence twelve (12) hours after the vessel tenders a valid NOR unless sooner commenced and end when loading completed. If the vessel is compelled to wait for berth at anchorage point, shifting time from Anchorage Point to berth shall not count as laytime.

If Turn Time expires such holidays as Idul Adha, Idul Fitri, Islamic’s New Year’s Day, New Year, Independence Day, Christmas Day and Election Day , Laytime shall commence at 9:00 a.m. on the next Business Day unless loaded sooner.

Laydays shall be Weather Working Day of twenty-four (24) consecutive hours including Sundays, holidays with Idul Adha, Idul Fitri, New Year, Independence Day ,Good Friday and Christmas Holidays excepted, unless used in which event only time actually used in the loading shall count.

Laytime shall cease to be counted after completion of loading . But waiting shipper's export documents (PEB) count as laytime except first 12 consecutive hours.

Time lost by the following causes shall not count as laytime:

a)Loading interruption due to wind, rain, fog, or other natural causes, and interruptions due to cleaning being required after rain,unless the vessel is on demurrage.

b)Delays due to breakdown of the vessel’s loading equipment(s), ballasting equipment(s) or lighting equipment(s), or delays due to the vessel’s requirement(s) to change stowage plan or loading sequences.

c)In the event that all cargo are ready on barges, but the loading equipment provided by the vessel cannot perform well (not able to perform as per declared in the Vessel Nomination) and causing the actual Loading Rate lower than the agreed Loading Rate, i.e. grabs cannot optimally perform as per the specifications. Laytime shall be calculated based on the actual performance of the Vessel’s equipments.

d)If the Shipper can only use lesser number of cranes/ grabs during loading operation due to breakdown, inefficiency, repairs or any other inability of the vessel to load the coal due to whatever reason contributed by the vessel, then the Loading Rate and Terms shall be adjusted as below:

In case of vessel’s gear break down and Laytime to be deducted on basis of (4 cranes = 100%, 3 cranes = 65%, 2 cranes = 40%, 1 crane = 15%)and if floating crane requested to be for owners account ,and time not to count as Laytime during the period for waiting for floating crane.

e)Shifting time due to the vessel’s requirements (shifting time due to Shipper’s requirement shall count as laytime).

f)Taken from anchor aweigh or pilot on board, whichever is earlier, until the vessel is all fast, and ready in all respects to load (including hatches passed, customs clearance and free pratique, opening and/or closing hatch, if applicable);

g)Shifting and mooring of vessel during the loading operation.

h)Carrying out draft survey, either before or during the loading has started and also after the loading has completed.

i)Excess time before laycan starts resulting from the vessel arriving at Anchorage Point prior to the agreed laycan, provided however that in case the Shipper can arrange to load prior to such laycan, time actually used for loading shall count as laytime. Upon early arrival, early commence is entirely Shipperr’s option.

j)Laytime cease to count only after vessel completes loading. In the event the vessel is delayed in sailing from loading port for more than 12 hours after completion of loading, due to Shipper’s failure to complete all required documentation, shipper will be responsible for the costs of vessel’s detention. The detention rate shall be the same as demurrage rate. Detention time shall stop to count once all required documents delivered to vessel’s agent. Detention cost, if any to be settled together with demurrage/despatch

k)Time spent waiting due to system failure of Indonesian customs’ system necessary to clear documentation process .Unless the shipper or the Seller has failed to fulfill with the requirement of the Government for Coal export ,whether or not the Vessel is already on Demurrage.

l)Any time lost due to Force Majeure ;.

AT D/P:

In China,NOR to be tendered at any time day night Saturday Sunday and holidays included, whether in berth or not.

Laytime to commence 12 hours after Notice of Readiness tendered unless sooner commenced, in which case actual time used to count. If after berthing the vessel is found not to be in free pratique and in all respects not ready to discharge or free pratique is not granted on arrival at the berth, laytime shall be deemed not to have commenced until when the vessel is in fact in free pratique and in all respects ready to discharge.

Laytime (D/P)

Laytime shall commence twelve (12) hours after NOR tendered unless sooner commenced, which cease actual time used to count in full. Laytime shall cease to be counted after completion of discharging.

Time lost by the following causes shall not count as laytime(whether or not the Vessel is already on Demurrage):

a) inward passage from CJK anchorage until the Vessel is securely moored at the discharging berth; shifting from berth to other berth or anchorage and shifting form anchorage to the berth again if the Vessel has been ordered by the port authorities .

b) Taken from CJK anchor aweigh or pilot on board, whichever is earlier, until the vessel is all fast, and ready in all respects to discharge, (including hatches passed, customs clearance and free pratique, opening and/or closing hatch, if applicable);

c) time spent in conducting initial draft survey of the Vessel, and intermediate draft survey, if it is requested by the Master;

d) Breakdown or failure of the vessel to comply with the requirements or regulations of the discharging port causing delay or restriction to discharging operations;

e) discharging interruption due to wind ,rain, wave, fog or other natural causes, and interruption due to cleaning being required after rain and snow;

f) any other delay attributable to the Vessel or the Owners'Agents;

g) Due to the owner’s reasons, the actual time used for Government Agency or related to conduct quarantine and inspection to ease COVID 19 , even if the vessel is on demurrage.

满足南京最新疫情标准,船东保证不在卸港更换船员,否则船东承担全部时间损失及费用损失。

CJK等专班引水的时间正常计入装卸时间,长江口起锚至靠妥南电码头的时间不计入装卸时间,包括长江中临时抛锚等换引水的时间。
